Each country decides who can service a fire extinguisher, how often an alarm must be tested and which inspector can close a store. Add regional rules, local requirements and shopping centre regulations, and fire safety maintenance becomes one of the biggest legal risks for a retail network.

This guide explains how fire safety compliance works in the UK, what changes when a chain opens in other countries and continents, and which management model keeps every store compliant without multiplying suppliers. It is also the approach behind our fire protection maintenance for retail chains, which brings every store’s fire safety under a single schedule.

What is fire safety compliance in retail maintenance?

Fire safety compliance in retail maintenance is the assurance that every fire protection system in a store is checked, serviced and inspected at the frequency, by the people and with the records required by the law that applies in each location. It covers fire extinguishers, fire detection and alarm systems, emergency lighting, sprinklers, fire doors, signage and any automatic suppression system.

In a single store it is a technical task. Across an international network it is a management task: you need to know which rules apply in each unit, who is competent or certified to do the work, and how to prove to an inspector that everything was done on time.

How fire safety maintenance is regulated in the UK

In England and Wales, the core law is the Regulatory Reform (Fire Safety) Order 2005, usually called the Fire Safety Order. Scotland has its own regime under the Fire (Scotland) Act 2005, and Northern Ireland under the Fire Safety Regulations (Northern Ireland) 2010, but the principles are very similar.

Unlike Spain or France, the UK does not set a fixed national maintenance schedule in law. The system is risk-based: the law sets the duties, and recognised British Standards define what good maintenance looks like.

The Fire Safety Order and the responsible person

The Fire Safety Order places legal responsibility on the responsible person, usually the employer or the business that controls the premises. In a retail chain, that means the retailer for each of its stores. Their main duties are:

Carry out a suitable and sufficient fire risk assessment and keep it under review, especially after changes to the layout, stock or use of the store.

Record the full fire risk assessment and the fire safety arrangements in writing. Since October 2023, this applies to all businesses, whatever their size.

Keep fire safety equipment and facilities in efficient working order and good repair.

Appoint competent people to carry out the assessment and the maintenance, and train staff.

Cooperate and share information with other responsible persons in shared premises, such as shopping centres.

The British Standards that set the maintenance schedule

British Standards are not law, but they are what fire and rescue authorities and insurers use to judge whether a store’s maintenance is adequate. These are the key ones for retail:

System

Reference standard

Routine check by store staff

Service by a competent person

Fire detection and alarm

BS 5839-1

Weekly test from a different manual call point

At least every 6 months

Emergency lighting

BS 5266-1

Monthly brief functional test

Annual full rated duration test

Portable fire extinguishers

BS 5306-3

Regular visual checks, typically monthly

Annual basic service and extended service every 5 years (CO2 overhaul every 10 years)

Sprinklers

BS EN 12845

Weekly checks

Periodic inspections from quarterly to annual, plus longer-term tests

Fire doors

BS 8214

Regular visual checks of closers, seals and signage

Periodic inspection and repair by a competent person

For a chain, the challenge is not the frequency itself but keeping hundreds of fire alarm servicing visits, emergency lighting tests and extinguisher services in sync across every store, with the records to prove it.

Third-party certification and insurers

UK law requires competence, not a specific licence. In practice, many retailers and insurers ask for third-party certified contractors, for example under BAFE schemes for extinguisher servicing (SP101), fire alarm systems (SP203-1) and fire risk assessment (SP205). Certification is not compulsory, but it is the simplest way to demonstrate that the work was done by a competent person.

Enforcement and penalties in the UK

Fire and rescue authorities audit premises and can issue alterations, enforcement or prohibition notices, which can restrict or stop the use of a store. Serious breaches of the Fire Safety Order can lead to unlimited fines and up to two years’ imprisonment for the people responsible.

REQUEST A QUOTE

How fire safety rules change outside the UK

When a chain expands beyond the UK, it soon discovers that fire safety maintenance is not harmonised in most respects. What changes from one country to another is not so much the technology as the model of responsibility, the frequency of checks and who is authorised to carry them out.

Europe: harmonised products, national maintenance

Across Europe, fire protection products are largely built to common EN standards, many of which the UK has adopted as BS EN standards. In Spain, for example, the law itself fixes quarterly, annual, five-yearly and ten-yearly obligations; we explain them in our article on fire protection in retail premises in Spain.

The Americas, the Middle East and Asia

Outside Europe, the picture changes again:

United States: NFPA codes (such as NFPA 10 for extinguishers and NFPA 72 for fire alarms) are the reference, but they only become mandatory when each state or city adopts them. The local authority having jurisdiction decides which edition applies and how inspections work.

Mexico and Latin America: Mexico regulates fire protection in workplaces through NOM-002-STPS-2010. In many countries in the region, NFPA codes are used as the technical reference.

Middle East: in the United Arab Emirates, the fire and life safety code is enforced by each emirate’s Civil Defence, which usually requires maintenance contracts with approved companies.

Asia: national codes dominate, with additional requirements from large shopping malls, where much of the expansion of international chains takes place.

The conclusion for a chain is clear: there is no global standard. What can be global is the method used to manage it.

The risks of non-compliance across a store network

A fire safety failure rarely stays in one store. When it is found in one unit, it is often repeated in others that share the same contractor or the same procedure. The most common risks are:

Enforcement notices and fines for missing maintenance or records.

Restriction or closure of the store until the issues are fixed.

Insurance problems if a fire occurs and maintenance cannot be evidenced.

Civil and, in serious cases, criminal liability for the people responsible.

Reputational damage for the brand in every market where it trades.

For a chain, the real cost of non-compliance is not the fine but the disruption to trading and the loss of trust from landlords and shopping centre operators.

How to guarantee fire safety compliance in every country where you operate

Guaranteeing compliance across an international network means moving from separate contracts per store to a centralised management model. These are the steps that work best:

Asset register per store: every extinguisher, alarm panel, emergency light and sprinkler valve identified, with its installation date.

Regulatory matrix by country and region: which rules apply, which intervals they set and what certification the technician needs.

A single maintenance schedule: every store in one plan, with alerts before each due date. In the UK, include the review of each fire risk assessment.

Locally competent technicians: in each country, contractors with the accreditation its rules require.

Digital evidence: logbooks, certificates and photos accessible from head office, ready for any inspection.

Regular audits: checking that planned work was done and that the records are complete.

This model fits the way chains choose suppliers when they grow beyond their home market, as we explain in how to choose a maintenance provider for retail chains in Europe. And it does not stop at fire equipment: automatic doors on escape routes must also be maintained so they open in an emergency, as we cover in automatic door maintenance in retail.

When something fails outside the schedule, the response must be coordinated too. We explain how we handle those cases in how we manage retail facility management emergencies.

How we do it at Optima Retail

At Optima Retail we manage fire protection maintenance for retail chains with one model for the whole network: a centralised asset register, schedule and records, and competent technicians in every country where our clients trade.

For head office, that means a single point of contact for every store, guaranteed regulatory compliance in every market and minimal disruption to store activity, with visits scheduled outside trading hours wherever possible.

Does your network trade in several countries?
